Introduced by Rep. Matt Shea, (R-Spokane Valley) (R) on January 21, 2011, clarifies current law to continue the Department of Transportation’s policy giving priority consideration to abutting property owners in agricultural areas when disposing of property through its surplus property program. If the department determines that all or a portion of real property or an interest in real property that was acquired through condemnation within the previous ten years is no longer necessary for transportation purpose, the former owner has a right of repurchase. This act provides specific procedural requirements for notice to the former owner. This act takes effect July 1, 2011.
